Section 1 - Privacy
Statement...
This Privacy Policy covers Manage to WIN and/or Acappella
Information Systems and/or Greshtech Database Services (herein
after known as MtW) treatment
of personally identifiable information that we collect when you
are on our site and that we share or collect on behalf of our
business partners, organizations, leagues or governing bodies
(herein after known as Customer).
This policy does not apply to the practices of companies that
MtW does not own or control, or to
people that we do not employ or manage.

Section 2 - Privacy Policy Details...
MtW appreciates the importance of the
security and privacy of our registration information.
2.1 - Accountability
2.1a) MtW is responsible for personal
information under its control and shall designate an individual
or individuals who is/are accountable for compliance with these
ten privacy principles as outlined by the
Government of
Canada. If you have any questions about this Privacy Policy,
the practices of this site, or your dealings with us, you can
contact us via
e-mail.
2.2 - Identifying Purposes
2.2a) The purposes for which personal information is collected
shall be identified by MtW at or before the time
the information is collected.
2.2b) Our Customers are
committed to maintaining the privacy of your information as
outlined and they will be required to comply with this Privacy Statement
and Privacy Policy.
2.3 - Consent
2.3a) MtW will only gather personal
information that is voluntarily provided. We will not collect any information without
disclosing ahead of time why and how we are collecting, using or
disclosing personal information, either through this
Privacy Policy, or at the time we are requesting personal
information. We understand and confirm that by providing us with
personal information you are consenting to its use in
accordance with the principles outlined in this Privacy Policy.
2.3b)
We do not knowingly collect personal information from children
under 13 years of age and if a user is under the age of 13, they
must have consent from a parent or guardian before accessing
this site.
2.3c) Separate access via an alternate Registered Username is
not permitted.
2.3d)
Access and viewing of statistics is allowed by children under
the age of 13 and no personal information is gathered for this
service.
2.4 - Limiting Collection
2.4a)
The collection of personal information will not be used or
disclosed for purposes other than those for which the
information was collected except with the consent of our
Customers.
2.5 - Limiting Use, Disclosure, and Retention
2.5a)
Personal information shall be retained only as long as necessary
for the fulfillment of services to Customers.
2.6 - Accuracy
2.6a)
Personal information shall be as accurate, complete, and
up-to-date as is provided by Registered Users.
2.6 - Safeguards
2.6a)
Personal information shall be protected in secure data storage
in order to safeguard it from unauthorized access.
2.7 - Openness
2.7a) MtW will make readily available to
Registered Users specific information about policies and
practices relating to the management of personal information.
2.8 - Individual Access
2.8a) Registered Users shall be informed of the existence, use, and
disclosure of his or her personal information and shall be given
access to that information. A Registered User shall be able to
challenge the accuracy and completeness of the information and
have it amended.
2.8b) MtW will provide Registered Users with reasonable access to
their information
and will use reasonable efforts to allow updating of
personal or general information to the extent the
updating will not compromise MtW's Privacy Policy or Terms of
Use.
2.8c) Registered User's passwords can be disclosed to the
Registered User only by means of an automated feature.
2.8d)
Disclosure of usernames and passwords is restricted to the
Registered User when permission is
received via the Registered User's email address.
2.8e) Modifications of the Registered User's username can only
be performed by MtW at the request of the Customer and/or the
Customer's Registered User. Permission must be received via the
Customer's registered email address and/or the Register User's
email address.
2.9 - Challenging Compliance
2.9a)
MtW will make readily available to
Registered Users the ability to inquire or lodge complaints
regarding the handling of personal information. MtW shall investigate all complaints and if a
complaint is found to be justified through either the internal
or external complaint review process, we shall take appropriate
measures, including, if necessary, amending our Privacy
Statement, Privacy Policy or Terms of Use agreements.
Section 3 - Terms of Use and Data
Ownership...
3.1 - User Obligations
3.1a) As a Registered User you must be 18 years of age and
agree to provide accurate, current and complete information
as required by the Customer.
3.2 - User Conduct
3.2a) User agrees not to interfere with the use and enjoyment of
this site.
3.2b) User agrees to abide by and comply with all local, provincial
and national laws. MtW will fully cooperate with law enforcement
authorities to assist in the apprehension of individuals abusing
this service contrary to those laws.
3.2c) User agrees to be solely responsible for the content submitted
to this site and shall not provide any material that violates
the rights of another or is illegal, harassing, defamatory, libelous, invasive of privacy or publicity rights, abusive,
threatening, harmful, vulgar, obscene or otherwise objectionable
material of any kind, or which may constitute or encourage a
criminal offense.
3.2d) User shall not attempt to interfere with, damage, disable,
overburden, impair or disrupt in any way any MtW service or
servers.
3.2e) User shall not use the site for "spamming" or the sending of
unsolicited messages of any type in bulk which provoke
complaints from recipients.
3.2f) User shall not use the site to harm or attempt to harm minors
in any way.
3.3 - Modification of Services
3.3a) MtW reserves the right at any time and from time to time, to
modify or discontinue, temporarily or permanently a specific
aspect of service with or without notice to the Customer or
Registered User. We may change our fee structure or fees to
reflect changes to said services. See section 4.3b for
suspension of service.
3.3b) Customized reports and features requested by the Customer
will be provided at a reduced programming rate and MtW is free
to offer these new reports and features to other Customers as
part of it's service offerings.
3.3c) Exclusive customized reports and features requested by the
Customer will be provided at the standard programming rate and
MtW is not permitted to include any of these exclusive
customized reports or features into it's regular service
offering.
3.4 - Access by Children
3.4a) If you are age 13 or under, you must have consent from a
parent, guardian and/or Registered User to use this service.
3.5 - Proprietary Rights
3.5a) You are permitted to use the content included in this site
only as expressly authorized by the Customer. Any other use,
including but not limited to the reproduction, distribution,
display, posting, mirroring, or transmission of the content of
this site is strictly prohibited.
3.6 - Data Ownership
3.6a) Data collected by MtW is done so on behalf of its Customers.
Registered Users need only provide information as required by
the guidelines or rules and regulations of the Customer. MtW
does not track what information is provided that does not adhere
to the guidelines or rules and regulations of the Customer.
3.6b) MtW acknowledges that the Customer has proprietary ownership
and interest in the data being collected. Therefore, MtW
does not assert any rights over the use of that data unless it
contravenes to existing Terms of Use obligations as agreed to by
the Customer and/or Registered Users.
3.7 - Data Publication
3.7a) External real-time distribution must be approved by the
Customer before MtW will release this information.
3.7b) External delayed distribution will be provided upon request
to the Customer by MtW within 2 business days of the request. The
Customer's data
will be provided in its raw state without charge. Data summary
report(s) will be provided at a cost previously agreed to by the
Customer at commencement of service.
3.7c) The Customer shall be entitled to distribute the data to
persons within their organization in accordance with the
conditions of this Terms of Use agreement.
3.7d) MtW will not sell, trade or otherwise disclose of any
portion of data collected for its Customers to any individual or
company. For the purposes of demonstration, promotion or
advertising MtW does permit access to the system in the form of
a demonstration account which contains fabricated data and any
similarity to persons living or dead is purely coincidental.
3.8 - Termination of Service
3.8a) Upon written notice of termination of service by the
Customer, data and any exclusive customized reports and features will be provided to the Customer within
2 business days of the notice.
The data will be provided in its raw state without charge.
3.8b) Termination data summary report(s) will be provided at a cost previously
agreed to by the Customer at commencement of service. MtW
may request payment before any termination data summary report(s) are programmed.
MtW will require a reasonable amount of time to program any
termination data summary reports.
3.8c) Access to the MtW service by the Customer and it's Registered Users will
continue for 15 days upon receipt of notice of termination
unless otherwise stated in the notice.
3.8d) The Customer's data and any exclusive customized reports
and features will then be
deleted and expunged from the SQL database on the MtW server
on the 16th day following the notice of termination unless
otherwise stated in the notice.
3.8e) All existing
encrypted backups both on and off the MtW server will be deleted
and expunged within 30 days of the notice of termination, unless
otherwise stated in the notice.
3.8f) MtW is not responsible to the Customer to recover data and
any exclusive customized reports and features for
any purpose after 30 days of the notice of termination. Nor is MtW responsible to the
Customer or to the Customer's Registered Users to
manipulate, organize or present the data other than in the raw
format provided at the time of
termination of service.
3.9g) MtW may suspend, reduce, limit or terminate service in any
aspect upon failure of Customer to pay invoices by due date on
the invoice and after sufficient written notice or warning is
given.
3.9 - Computer Viruses
3.9a) MtW makes every reasonable effort to ensure that this
service or server does not contain computer viruses, trojans and
other destructive elements.
3.10 - Limitation of Liability
3.10a) THE CUSTOMER OR REGISTERED USER AGREES THAT IN NO EVENT
SHALL MtW BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, RESULTING FROM THE
USE OF OR THE INABILITY TO USE THIS SERVICE OR FOR COST OF
PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM
THE CUSTOMER'S RELIANCE AND USE OF CONTENT ON THIS SITE OR
MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM
THE USE OF THIS SITE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR
ALTERATION OF REGISTERED USER'S TRANSMISSIONS OR DATA, INCLUDING
BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR
OTHER INTANGIBLE, EVEN IF MtW HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES. THE CUSTOMER AND REGISTERED USER
FURTHER AGREES THAT MtW SHALL NOT BE LIABLE FOR ANY DAMAGES
ARISING FROM INTERRUPTION, SUSPENSION OR TERMINATION OF MtW
SERVICES, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT,
INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHETHER
SUCH INTERRUPTION, SUSPENSION OR TERMINATION WAS JUSTIFIED OR
NOT, NEGLIGENT OR INTENTIONAL, INADVERTENT OR ADVERTENT.
3.11 - Indemnification
3.11a) The Customer or Registered User agrees to indemnify, defend
and hold harmless MtW, from and against any and all losses,
expenses, damages and costs, including reasonable attorneys'
fees, resulting from the Customer's or Registered User's
violation of the terms of the Terms of Use agreement, any
activity related to the use of MtW (including negligent or
wrongful conduct) by the Customer or Registered User or any
other person accessing the site using the Registered User's ID
and Password, the Registered User's connection to the site and
MtW or the Customer's or Registered User's violation of any
rights of another, including any claim or demand made by any
third party due to or arising out of Customer's or Registered
User's use of MtW.
Section 4 - Security, Storage and
Backup...
This information is provided by Manage to WIN to address
concerns individuals and parents may have over the security of
information stored.
4.1 - Secure Server Location
4.1a) The MtW server is located in a highly secure environment
located in downtown Toronto.
4.1b) The building houses some of Canada's largest corporations
where a secure computing infrastructure and uninterrupted
Internet connection is part of their strategic business asset
(and ours).
4.1c) Access is granted only by escort with proper pre-arranged
documentation.
4.2 - Secure Perimeter and Hardware
4.2a) The MtW website is hosted on a Dell PowerEdge server which
includes security features to inhibit tampering or theft of data
and is enclosed behind a secure perimeter.
4.2b) Access is granted only to MtW's ISP. (The-Wire).
4.3 - Operating System and Security
4.3a) The MtW server runs Microsoft's Windows Server 2003 which
includes the latest security safeguards for digital information
— both online and offline, inside and outside of the firewall. For additional information visit

4.3b) MtW may with or without notice periodically suspend its
service while all essential software security enhancements are
installed and implemented.
4.3c) Access is controlled by username and enhanced password and
is granted only to MtW staff.
4.4 - Data Storage and Secure Backup
4.4a) All data is stored in a Microsoft SQL Server database which
has received the highest security ratings in the industry.
4.4b) Access to the SQL database is controlled by username and
password and is granted only to MtW staff.
4.4c) Daily backups are encrypted and stored in an alternate
location on the MtW server. For redundancy, periodic encrypted
backups are also kept in a secure location off the server.
4.5 - Hardware and Software Ownership
4.5a) All hardware, operating system software, tools and utilities
are the sole ownership of MtW. No outside organizations, or
lending institutions have access to the MtW server nor are there
any liens against MtW.
4.5b) The MtW programming (back-end) and interface (front-end)
remain the sole ownership of MtW.
4.5c) Ownership of any customized reports and features
(exclusive or otherwise) requested by the Customer and
programmed by MtW will adhere to sections 3.3b and 3.3c under
the Terms of Use and Data Ownership agreement.
